Terms

Buyer and dealer terms

Buyers accept the buyer terms when they open an account; dealers, who may buy too, accept them when they apply. Dealers accept the dealer terms when they apply, and again for every vehicle they list. Below is the text people accept today, with its version. When a text changes it gets a new version, and the site records which version each person accepted, in which language, and when.

Both texts are drafts and not in force. A Dutch lawyer checks them, under Dutch law, before the first sale. The terms are in Dutch and in English; the Dutch text prevails.

Buyer terms

Version 2026-11-eu-draft-4 Draft, not in force

  1. One asking price. Every vehicle has one asking price, shown to every buyer. Offers are private, and the asking price never changes because of an offer.
  2. Private offers. You may have one open offer per vehicle. Mobility1 answers offers for the seller, one at a time and within 24 hours: accept, decline, or a counter-offer to you alone. No other buyer sees your offer.
  3. Nothing binds until agreed. An offer binds no one until it is accepted for the seller and you both sign the sale agreement. You may withdraw an offer until you reserve.
  4. Reserving. To reserve a vehicle, at the asking price or at your accepted offer, you pay the buyer service fee (€250 including VAT) to Mobility1 itself, exactly as your payment page shows: by iDEAL or card through Stripe, our payment provider, or by bank transfer to Mobility1's own account. The first payment to arrive reserves the vehicle and locks it for you for 72 hours. Money that arrives after the vehicle was reserved is refunded in full, to where it came from.
  5. Refunds. The fee is refunded in full if the seller does not go ahead. If you withdraw after reserving, we keep €62.50 including VAT for the checks done for you and refund the rest. Refunds go back to the account or card the money came from.
  6. Paying for the vehicle. The dealer is the seller. You, or your lender, pay the whole price straight into the dealer's business account that Mobility1 checked, as My desk shows it, within the 72 hours of your reservation; an instant transfer arrives within seconds. Mobility1 never receives the price. Once the dealer confirms the money is in, the vehicle stays reserved for you until the sale is done. If the dealer has not confirmed a payment by the end of the working day after the 72 hours, the reservation ends as if you had withdrawn. If the sale does not go ahead, the dealer refunds what you paid it. Mobility1 never asks you to pay a person.
  7. Inspections. A Mobility1 inspection report describes the vehicle's condition on the inspection date. It is not an APK or RDW inspection, and it is not a warranty.
  8. Business buyers. Accounts are for registered businesses. Before your first offer or reservation you send one cent from your company's own business account with your code, and we check that the account's name is the company's in the KvK register. We use these details only to verify you and to run your purchases.

Dealer terms

Version 2026-11-eu-draft-3 Draft, not in force

  1. You are the seller. You set the asking price of each vehicle. The buyer, or the buyer's lender, pays the whole price directly into your verified business account; you pay Mobility1's commission as in point 6. For each vehicle you say whether you sell it under the margin scheme or with VAT, and you answer for that statement: the asking price of a vehicle sold with VAT includes 21% VAT, which your invoice shows.
  2. Exclusive marketing. For the period you choose (7 to 30 days) you do not sell the vehicle elsewhere.
  3. Inspection first. Mobility1 inspects every vehicle and its documents before it is listed. A failed document keeps the vehicle off the site.
  4. Offers through Mobility1. You give us your lowest price for each vehicle; it stays private and buyers never see it. You authorise Mobility1, as your agent, to answer private offers for you, one at a time and within 24 hours: to accept on your behalf an offer at or above your lowest price, to decline, or to make one counter-offer that is not below it. You do not see offers. When a vehicle is reserved we tell you the price, and the buyer pays it to you as in point 1. You never ask buyers to compete with each other, on or off the site.
  5. Fixed price. The asking price does not change while an offer is open; any change goes back to review.
  6. Commission. Mobility1's commission is 2.5% of the final price, for a vehicle sold with VAT of the price including its VAT, at least €300 and at most €3,000, plus 21% VAT, for every vehicle sold to a buyer who reserved it through Mobility1. Abitech Worldwide Management Holding B.V. invoices it to you once the sale is done; you pay the invoice within 14 days, to the account it shows.
  7. Handover. As soon as the whole price is in your account, from the buyer or the buyer's lender, you confirm it on the site, by the end of the working day after the reservation's 72 hours at the latest. Only then do you hand over the vehicle and transfer it to the buyer at the RDW, and you enter the transfer reference. If the sale does not go ahead, you refund the buyer what it paid you.
  8. Your data. We use your company details to verify you, to run your sales and to issue invoices.
